These terms govern your use of this website. Paid audit and consulting engagements are governed by a separate engagement letter, not by these terms. This is a draft pending review by counsel.

Not legal advice

This website, and any clarification session, provide information and a professional view, not legal advice. An independent audit is a professional opinion delivered under an engagement letter; nothing on this site creates that engagement or an auditor relationship. For legal determinations, consult qualified counsel.

This applies with equal force to our technical classification analysis. That engagement establishes technical facts about a system for the instructing lawyer or legal team. It does not determine the system's classification under the EU AI Act or any other law, and it is not legal advice. The legal determination, and any advice given in reliance on our analysis, remain the responsibility of the instructing counsel.

Independence

Probus maintains a strict independence wall. We do not audit a system we helped build, sell, or operate, and we do not provide both audit and consulting to the same client or system, with a 12-month cooling-off. Fees are never contingent on an audit outcome.

Technical classification analysis sits on the audit side of that wall, because it establishes facts rather than building or remediating a system. Where we have provided such analysis, we disclose it before accepting an audit engagement covering the same system, and the audit team re-performs the analysis rather than relying on our earlier work.

Use of the site

• Do not attempt to disrupt, probe, or misuse the site.

No warranty; limitation of liability

The website is provided "as is", without warranties of any kind. To the fullest extent permitted by law, Probus is not liable for loss arising from use of the website. Liability under a paid engagement is governed solely by that engagement's letter and terms. Nothing here limits liability that cannot be excluded by law.
